The Case transferred from the Constitutional Court was reverted

The Session of all justice of the Supreme Court of Mongolia was held on May 30, 2018.
The Session discussed the ruling of Constitutional Court on “Legal dispute that no jurisdiction is being considered by the court” dated on 19th of April 2017, by the request from the Chamber for Administrative Cases of the Supreme Court
of Mongolia on the.
The ruling of Constitutional Court was the Chamber for Administrative Cases of the Supreme Court of Mongolia have first instance jurisdiction over a dispute about violation on rights, concerning with the failure of 12 judges which
has to be reinstated.
"Article 51, paragraph 1 of the Constitution of Mongolia stipulates that" the Supreme Court of Mongolia has the power to try at first instance criminal cases and legal disputes under its jurisdiction. Therefore, the law does not
establish jurisdiction and there is no legal basis for the Chamber for Administrative Cases of the Supreme Court of Mongolia to make judgment on disputes not specifically designated by the Parliament.
On the other hand, Article 14 of the Law on Procedure of Constitutional Tsets states: "If a citizen, a public official or a public organization complains to the jurisdiction which no jurisdiction is to be taken, the jurisdiction shall be determined
and transferred to the relevant court". However, Session of the Supreme Court decided that on the judgment of the Constitutional Tsets stated, "... Chamber for Administrative Cases of the Supreme Court of Mongolia have first instance
jurisdiction over a dispute …" was the Constitutional Tsets established a jurisdiction over the Constitution and Court matters with its procedure.
As for this the ruling of Constitutional Court on “Legal dispute that no jurisdiction is being considered by the court” dated on 19th of April 2017, was reverted back by the Session resolution 11 of the Supreme Court of Mongolia.
